Nawaz Sharif’s return to Pakistan: Can the government take legal action against opposition leader Shahbaz Sharif? The Pakistan Tehreek-e-Insaf (PTI) government has decided to take legal action against opposition leader Mian Shahbaz Sharif in the National Assembly following contradictory claims by PML-N lawmakers about the return of his party leader Mian Nawaz Sharif.
It may be recalled that in the court decision to send former Prime Minister Nawaz Sharif to London for treatment, an affidavit was submitted by Shahbaz Sharif in which he had guaranteed his brother’s return to Pakistan.
According to Federal Minister for Information Fawad Chaudhry, Shahbaz Sharif had promised to bring his brother back home after four weeks and since that did not happen, the government would file a petition against him in the Lahore High Court.
Talking to BBC, he said that the Supreme Court should take suo moto notice in this regard and summon Mian Shahbaz Sharif.
He said that as no action has been taken by the Lahore High Court on the matter so far, the federal government has decided to file a petition in the Lahore High Court against the Leader of the Opposition in the National Assembly. However, he did not say when the petition would be filed.
What did Mian Shahbaz Sharif say in his affidavit?
Shahbaz Sharif’s affidavit in the Lahore High Court regarding the return of Mian Nawaz Sharif after he was sent abroad stated that his elder brother Mian Nawaz Sharif would go abroad for treatment for four weeks. He said that if Nawaz Sharif’s health was restored during this period and doctors allowed him to go to Pakistan, he would return home.
The affidavit also states that during this period, Nawaz Sharif’s medical reports will be sent to the Registrar of the High Court after verification by the London High Commission.
The affidavit filed by Mian Shahbaz Sharif in the Lahore High Court also said that if ever the federal government had credible information that Mian Nawaz Sharif was staying in London despite being healthy, then the Pakistan High Commission based in the UK. In this regard, an official of the party can meet Nawaz Sharif’s doctor and inquire about his health.
Apart from Mian Shahbaz Sharif, Nawaz Sharif’s affidavit was also submitted to the court at that time in which he said that he was bound to abide by the affidavit given by his brother.
Will the government be able to bring Nawaz Sharif back to Pakistan from Britain?
On Sunday, Dr. Firdous Ashiq Awan, Special Assistant to the Prime Minister for Information and Broadcasting, told the media that it was time to bring back Mian Muhammad Nawaz Sharif, a VIP prisoner who had gone to Britain from Pakistan for treatment. ۔ Therefore, the federal government is going to write a letter to the British government to deport them from Britain.
Reacting to the statement, PML-N leader Rana Sanaullah said, “I challenge the PTI to approach the British government for the deportation of former Prime Minister Nawaz Sharif, who is staying in London for medical treatment.” ۔ ‘
Talking to the BBC about the international law on extradition of a person, lawyer Hashim Ahmed Khan said that the government would have to adopt a certain procedure to bring Nawaz Sharif to Pakistan and this decision would depend on the British Home Secretary.
